Giveaway Drawing Rules

Review the standing rules that apply to Project Polaris giveaways and random prize drawings.

These Giveaway Drawing Rules (the Rules) govern each chance-based giveaway or drawing (a Giveaway) sponsored by Project Polaris (the Organizer). Each Giveaway is a sweepstakes, not a skill-based contest. It is not intended to constitute gambling or an illegal lottery. Each Giveaway announcement (the Giveaway Notice) orally or in writing supplements these Rules and identifies the entry period, prize or prizes, free entry method, drawing timing, and other Giveaway-specific details. If a Giveaway Notice conflicts with these Rules, these Rules control unless the Giveaway Notice expressly identifies the provision it replaces. By entering, each entrant agrees to these Rules and the applicable Giveaway Notice.

Eligibility

Unless the Giveaway Notice states a narrower eligible area, a Giveaway is open only to legal residents of the 50 United States and the District of Columbia who are at least 18 years old and have reached the age of majority where they reside at the time of entry.

The Organizer’s directors, officers, employees, volunteers, moderators, agents, and representatives are not eligible. Their immediate family members and household members are also not eligible. Immediate family member means a spouse, parent, stepparent, child, stepchild, sibling, step sibling, or the spouse of any of those people, regardless of where the person lives. Household member means anyone who shares the same residence for at least three months in a year, whether related or not.

A potential winner must be present to win. The Giveaway Notice will explain when, where, and how an entrant must be present. A Giveaway is void outside the eligible area and wherever prohibited or restricted by law. Eligibility is subject to verification.

Giveaway Notice and entry period

The Giveaway Notice will clearly and conspicuously state:

  • The date, time, and time zone when entry opens and closes.
  • The prize description, quantity, and approximate retail value.
  • The free entry procedure and the information an entrant must provide.
  • Where and when the drawing will occur and what qualifies as being present.
  • How and when a potential winner must respond and claim the prize.
  • Any terms that apply only to that Giveaway.

The Organizer’s designated timekeeping system is the official clock. Entries received before or after the entry period are void.

How to enter

Follow the free entry procedure in the Giveaway Notice. A Giveaway may accept an entry through an online form or through a moderator-controlled chat window identified in the Giveaway Notice. Entry never requires a purchase, payment, or other monetary consideration.

Unless the Giveaway Notice expressly permits additional entries, there is a limit of one entry per person per Giveaway. Multiple entrants may not share the same email address, account, identity, or other entry credential. An entrant may not submit an entry for another person. Automated, bulk, generated, scripted, bot-assisted, or fraudulent entries are void.

An entry is received only when the Organizer receives a complete submission through the stated method. Proof that an entrant attempted to transmit an entry is not proof of receipt. The Organizer is not responsible for lost, late, incomplete, corrupted, misdirected, unintelligible, or undelivered entries or for technical or communications failures outside the Organizer’s reasonable control.

Odds of winning

The odds of winning depend on the number of eligible entries received for the applicable Giveaway. A purchase, payment, or donation does not improve an entrant’s odds.

Random drawing and winner verification

The Organizer will select each potential winner at random from all eligible entries received, at the time or within the period stated in the Giveaway Notice. The Organizer’s decisions concerning administration, eligibility, and selection are final and binding to the extent permitted by law.

A selected entrant must be present as the Giveaway Notice requires. The Organizer may contact a potential winner by email, telephone, or a direct reply or private message through the entry channel, using the contact information associated with the entry. A potential winner must respond and complete any required verification within the period in the Giveaway Notice.

A selected entrant is not a winner unless and until the Organizer verifies eligibility and compliance with these Rules and the Giveaway Notice. The Organizer may require proof of identity, age, residence, presence, or entry ownership, and may require an eligibility declaration, liability release, tax documentation, or other lawful claim documents. If a potential winner is ineligible, cannot be contacted, does not respond on time, is not present as required, declines the prize, or does not complete the required documents, the prize may be forfeited and the Organizer may randomly select an alternate potential winner.

Prizes

The Giveaway Notice will describe each prize, its quantity, and its approximate retail value. A prize is awarded as stated, without warranty from the Organizer, except for any warranty that cannot legally be excluded. A winner may not transfer, assign, or redeem a prize for cash unless the Giveaway Notice permits it. The Organizer may substitute a prize of equal or greater value if the advertised prize becomes unavailable for reasons outside the Organizer’s reasonable control.

A winner is responsible for all federal, state, and local taxes and all costs not expressly included in the Giveaway Notice. The Organizer may report the prize to taxing authorities and issue required tax forms. No more than the stated number of prizes will be awarded.

Conduct and disqualification

The Organizer may disqualify an entrant who tampers with an entry process or Giveaway, acts fraudulently or disruptively, violates these Rules or the Giveaway Notice, supplies false information, or attempts to obtain an unfair advantage. The Organizer may pursue any remedies available by law. A failure to enforce a provision in one instance is not a waiver of that provision.

Entrants must comply with the terms, acceptable-use rules, and community or content standards of any service used to communicate or enter a Giveaway. An entrant must not encourage unlawful conduct, inaccurate tagging or identification, spam, harassment, infringement, or deceptive endorsements in connection with a Giveaway.

Changes, suspension, or cancellation

If fraud, technical failure, human error, tampering, severe weather, natural disaster, or another event outside the Organizer’s reasonable control impairs the integrity or proper operation of a Giveaway, the Organizer may suspend, modify, or cancel it to the extent permitted by law. If feasible and lawful, the Organizer may award the prize by a random drawing from eligible, unaffected entries received before the action. The Organizer will not change a Giveaway in a way that unfairly disadvantages entrants.

Personal information and winner announcements

The Organizer will use personal information to administer the Giveaway, verify eligibility, contact potential winners, deliver prizes, satisfy legal obligations, prevent fraud, and otherwise act as described in the Privacy Policy. Entry does not enroll an entrant in marketing communications unless the entrant separately and affirmatively agrees.

The Organizer may announce or provide a winner list containing only a winner’s first name and first initial of the last name. The Organizer will not publish a winner’s email address, city, or state as part of a winner announcement or list. Any use of a winner’s likeness or statements requires separate consent.

Organizer

The Organizer is solely responsible for administering each Giveaway. Any third-party service used to communicate a Giveaway or transmit an entry is not an organizer or administrator. A Giveaway is not sponsored, endorsed, administered by, or associated with such a service. To the extent permitted by law, each entrant releases any such service from claims arising from the Giveaway.

Release and limitation of liability

To the fullest extent permitted by law, each entrant agrees to release and hold harmless the Organizer and its directors, officers, employees, volunteers, moderators, agents, and representatives from claims, injuries, losses, liabilities, or damages arising from participation in a Giveaway or the acceptance, possession, use, or misuse of a prize. This provision does not exclude liability that cannot legally be limited or excluded.

The Organizer is not liable for an indirect, incidental, consequential, special, or punitive loss arising from a Giveaway to the extent such a limitation is permitted by law. Nothing in these Rules limits any consumer right or remedy that the law does not allow to be waived.

Disputes and governing law

Before filing a claim, an entrant must give the Organizer written notice describing the dispute and allow 30 days for a good-faith effort to resolve it, unless applicable law gives the entrant the right to proceed sooner. These Rules and each Giveaway are governed by Oregon law, without regard to conflict-of-law principles. Subject to any right that cannot legally be waived, claims must be brought individually in a state or federal court with jurisdiction in Multnomah County, Oregon. Class, consolidated, and representative proceedings are waived only to the extent the waiver is lawful.

General terms

All federal, state, and local laws apply. If a provision of these Rules is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. Headings are for convenience and do not affect interpretation.
